Instrumenti i studimit p\u00ebrfshin 55 pyetje t\u00eb r\u00ebnd\u00ebsishme t\u00eb organizuara n\u00eb kat\u00ebr fusha: p\u00ebrgatitja, prokurimi, menaxhimi i kontratave dhe nj\u00eb modul i ve\u00e7ant\u00eb i propozime t\u00eb pa k\u00ebrkuara.<\/p>\n<ol>\n<li><strong>P\u00ebrgatitja e PPP-ve<\/strong>: Kjo pjes\u00eb mbulon periudh\u00ebn dhe aktivitetet q\u00eb informojn\u00eb n\u00ebse do t\u00eb nis\u00eb nj\u00eb proces prokurimi PPP apo jo. Kjo pjes\u00eb e studimit hulumton n\u00ebse identifikimi i nj\u00eb projekti PPP t\u00eb ardhsh\u00ebm ndodh brenda kontekstit m\u00eb t\u00eb gjer\u00eb t\u00eb investimeve publike, n\u00eb p\u00ebrputhje me prioritetet e tjera t\u00eb qeveris\u00eb. P\u00ebr m\u00eb tep\u00ebr, konsideron aktivitete t\u00eb tjera t\u00eb nd\u00ebrmarra para publikimit t\u00eb njoftimit t\u00eb tenderit, si\u00e7 \u00ebsht\u00eb p\u00ebrgatitja e dokumenteve t\u00eb tenderit dhe marrja e tok\u00ebs\/lejeve, q\u00eb \u00e7ojn\u00eb n\u00eb prokurimin e projektit PPP.<\/li>\n<li><strong>Prokurimi i PPP-ve<\/strong>: Kjo pjes\u00eb p\u00ebrqendrohet n\u00eb procesin e zgjedhjes s\u00eb nj\u00eb privat partneri p\u00ebr t\u00eb marr\u00eb p\u00ebrsip\u00ebr p\u00ebrgjegj\u00ebsin\u00eb e zhvillimit t\u00eb projektit PPP. Ky seksion mbulon nj\u00eb s\u00ebr\u00eb temash, p\u00ebrqendrohet n\u00eb faktin n\u00ebse korniza t\u00eb ndryshme ligjore dhe rregullatore n\u00eb t\u00eb gjith\u00eb globin i p\u00ebrmbahen praktikave t\u00eb mira t\u00eb njohura n\u00eb drejtim t\u00eb zgjedhjes s\u00eb partnerit privat. Temat kryesore t\u00eb p\u00ebrfshira n\u00eb k\u00ebt\u00eb seksion p\u00ebrfshijn\u00eb drejt\u00ebsin\u00eb, neutralitetin dhe transparenc\u00ebn e procesit, si dhe k\u00ebrkesat specifike lidhur me \u00e7\u00ebshtjet q\u00eb lidhen me to n\u00eb munges\u00eb t\u00eb konkurrenc\u00ebs.<\/li>\n<li><strong>Menaxhimi i kontratave PPP<\/strong>: Ky seksion vler\u00ebson korniz\u00ebn e menaxhimit t\u00eb kontrat\u00ebs n\u00eb vend, p\u00ebr t\u00eb leht\u00ebsuar zbatimin e projekteve t\u00eb PPP, si dhe sistemet e vler\u00ebsimit. Ai gjithashtu shqyrton dispozitat rregulluese lidhur me PPP-t\u00eb, modifikimin e kontrat\u00ebs dhe rinegocimin, zgjidhjen e mosmarr\u00ebveshjeve, t\u00eb drejtat e huadh\u00ebn\u00ebsit, dhe nd\u00ebrprerjen e kontratave.<\/li>\n<li><strong>Propozimet e pa k\u00ebrkuara p\u00ebr PPP-t\u00eb<\/strong>: Ky seksion fillon duke p\u00ebrcaktuar n\u00ebse ligji dhe kuadri rregullator n\u00eb m\u00ebnyr\u00eb specifike lejon ose ndalon dor\u00ebzimin e propozimeve t\u00eb pak\u00ebrkuara dhe n\u00ebse ato zhvillohen n\u00eb praktik\u00eb. Kjo pjes\u00eb e punimit vler\u00ebson dhe analizon mekanizmat n\u00eb fuqi p\u00ebr propozimet e pak\u00ebrkuara, si dhe n\u00ebse egziston nj\u00eb proces konkurrues p\u00ebr t\u00eb zgjedhur partnerin privat p\u00ebr projektin PPP.<\/li>\n<\/ol>\n<p>__________<\/p>\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> \u201cBenchmarking PPP Procurement\u201d ka nisur n\u00eb vitin 2015 me q\u00ebllim p\u00ebr t\u00eb mb\u00ebshtetur procesin e politik\u00ebb\u00ebrjes, duke theksuar apektet ky\u00e7e t\u00eb kuadrit rregullativ t\u00eb nj\u00eb ekonomive p\u00ebr prokurimin e PPP-ve. Kjo praktik\u00eb u frym\u00ebzua nga metodologjia e grupit t\u00eb Bank\u00ebs Bot\u00ebrore, Doing Business report, i cili vler\u00ebson klim\u00ebn e biznesit n\u00eb 190 ekonomi.<\/p>\n<p>&nbsp;<\/p>\n<p>Rezultatet e mundshme variojn\u00eb nga 0 n\u00eb 100. Ekonomit\u00eb me rezultatet m\u00eb t\u00eb larta, af\u00ebrsisht 100, konsiderohen t\u00eb ken\u00eb nj\u00eb korniz\u00eb PPP q\u00eb \u00ebsht\u00eb e lidhur ngusht\u00eb me praktikat e mira nd\u00ebrkomb\u00ebtare. N\u00eb t\u00eb kund\u00ebrt, ekonomit\u00eb me rezultat t\u00eb ul\u00ebta (af\u00ebrsisht 0) kan\u00eb hap\u00ebsira t\u00eb konsiderueshme \u200b\u200bp\u00ebr p\u00ebrmir\u00ebsim sepse ato nuk i p\u00ebrmbahen praktikave t\u00eb mira nd\u00ebrkomb\u00ebtare\u00a0 t\u00eb PPP-ve.<\/p>\n<p><strong><em><u>P\u00ebrgatitja e PPP-ve<\/u><\/em><\/strong><\/p>\n<p>Duke pasur parasysh kompleksitetin, madh\u00ebsin\u00eb dhe natyr\u00ebn afatgjat\u00eb t\u00eb projekteve PPP, para se t\u00eb merret vendimi p\u00ebr t\u00eb filluar nj\u00eb procedur\u00eb prokurim PPP-je, autoriteti kontraktor duhet \u00a0t\u00eb kryej vler\u00ebsime rigoroze p\u00ebr t\u00eb vler\u00ebsuar q\u00ebndrueshm\u00ebrin\u00eb e projektit. Kjo faz\u00eb p\u00ebrgatitore \u00ebsht\u00eb shum\u00eb e r\u00ebnd\u00ebsishme pasi siguron q\u00eb vet\u00ebm nj\u00eb projekt i mir\u00eb-strukturuar, i q\u00ebndruesh\u00ebm PPP-je, i cili ka m\u00eb shum\u00eb gjasa t\u00eb ofroj\u00eb vler\u00eb p\u00ebr para t\u00eb vazhdoj n\u00eb faz\u00ebn e prokurimit.<\/p>\n<p>P\u00ebr t\u00eb vler\u00ebsuar performanc\u00ebn e faz\u00ebs p\u00ebrgatitore shihet n\u00ebse vler\u00ebsimet e m\u00ebposhtme jan\u00eb nd\u00ebrmarr\u00eb gjat\u00eb faz\u00ebs s\u00eb p\u00ebrgatitjes: (1) analiza socioekonomike; (2) vler\u00ebsimi i p\u00ebrballueshm\u00ebris\u00eb fiskale; (3) identifikimi, alokimi dhe vler\u00ebsimi i rreziqeve; (4) nj\u00eb vler\u00ebsim krahasues me alternativat tradicionale t\u00eb prokurimit (ose vler\u00ebsimi p\u00ebr vler\u00ebn e parave); (5) vler\u00ebsimi i q\u00ebndrueshm\u00ebris\u00eb financiare ose realizueshm\u00ebria ekonomike e projektit; dhe (6)\u00a0 vler\u00ebsimi i ndikimit n\u00eb mjedis.<\/p>\n<p><em><u>Vler\u00ebsimi i raportit p\u00ebr faz\u00ebn e p\u00ebrgatitjes s\u00eb PPP-ve: <\/u><\/em><\/p>\n<p><a href=\"http:\/\/www.atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-pergatitjes.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1216\" src=\"http:\/\/www.atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-pergatitjes.png\" alt=\"\" width=\"511\" height=\"235\" srcset=\"https:\/\/atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-pergatitjes.png 511w, https:\/\/atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-pergatitjes-300x138.png 300w\" sizes=\"auto, (max-width: 511px) 100vw, 511px\" \/><\/a><\/p>\n<p>Kur hyjn\u00eb n\u00eb kontrata PPP, qeverit\u00eb mund t\u00eb ken\u00eb angazhime fiskale t\u00eb tilla: t\u00eb drejtp\u00ebrdrejta (si\u00e7 jan\u00eb pagesat e disponueshm\u00ebris\u00eb) dhe detyrimet kontingjente (si p.sh. garancit\u00eb ose klauzolat e kompensimit) ngjarja, koha dhe vlera e t\u00eb cilave varen nga disa ngjarje t\u00eb pasigurta n\u00eb t\u00eb ardhmen. Pa k\u00ebto detyrime q\u00eb llogariten (n\u00ebp\u00ebrmjet financave publike), PPP-t\u00eb mund t\u00eb p\u00ebrdoren p\u00ebr t\u00eb anashkaluar kontrollet buxhetore dhe fiskale duke ndikuar n\u00eb q\u00ebndrueshm\u00ebrin\u00eb e p\u00ebrgjithshme fiskale t\u00eb ekonomis\u00eb.<\/p>\n<p>Pavar\u00ebsisht nga r\u00ebnd\u00ebsia e k\u00ebsaj \u00e7\u00ebshtjeje, vler\u00ebsimi i duhur i implikimeve fiskale t\u00eb PPP-ve ende nuk \u00ebsht\u00eb praktik\u00eb e zakonshme n\u00eb disa vende. Nj\u00eb shumic\u00ebn e ekonomive t\u00eb anketuara (81 p\u00ebrqind) k\u00ebrkohet nj\u00eb miratim nga Ministria e Financave ose autoriteti buxhetor qendror para se t\u00eb filloj\u00eb procesi i prokurimit PPP. Megjithat\u00eb, vet\u00ebm 54 p\u00ebrqind e t\u00eb gjitha ekonomive t\u00eb anketuara k\u00ebrkojn\u00eb nj\u00eb miratimi shtes\u00eb para se t\u00eb n\u00ebnshkruhet kontrata e PPP. Ky miratim i dyt\u00eb mund t\u00eb jet\u00eb i r\u00ebnd\u00ebsish\u00ebm p\u00ebr t\u00eb siguruar q\u00eb projekti \u00ebsht\u00eb ende i p\u00ebrballuesh\u00ebm nga ana fiskale p\u00ebr qeverin\u00eb pas ndryshimeve t\u00eb konsiderueshme q\u00eb mund t\u00eb ken\u00eb ndodhur gjat\u00eb procesit t\u00eb tenderimit.<\/p>\n<p><strong><em><u>Prokurimi i PPP-ve<\/u><\/em><\/strong><\/p>\n<p>Suksesi afatgjat\u00eb i nj\u00eb PPP varet n\u00eb mas\u00eb t\u00eb madhe nga zgjedhja e partnerit privat m\u00eb t\u00eb p\u00ebrshtatsh\u00ebm. Vlera e synuar p\u00ebr para p\u00ebrmes PPP \u00ebsht\u00eb e kusht\u00ebzuar nga kapaciteti i partnerit privat p\u00ebr inovacion dhe aft\u00ebsia e tij p\u00ebr t\u00eb\u00a0 arritur fitimet e mundshme. R\u00ebnd\u00ebsia e zgjedhjes s\u00eb partnerit t\u00eb duhur theksohet p\u00ebr dy arsye: nga natyra afatgjat\u00eb e projekteve PPP dhe madh\u00ebsia e burimeve publike n\u00eb rrezik.<\/p>\n<p>Vler\u00ebsimi i procesit t\u00eb prokurimit \u00ebsht\u00eb konceptuar mjaft i gjer\u00eb duke p\u00ebrfshir\u00eb aspekte t\u00eb ndryshme t\u00eb procesit t\u00eb prokurimit, t\u00eb tilla si qasja e ofertuesve me informacionin lidhur me prokurimin, qart\u00ebsia dhe gjith\u00ebp\u00ebrfshirja e dokumenteve t\u00eb prokurimit, kualifikimi i an\u00ebtar\u00ebve t\u00eb komisionit t\u00eb vler\u00ebsimit t\u00eb ofertave, kriteret e p\u00ebrzgjedhjes s\u00eb ofertave t\u00eb p\u00ebrdorura gjat\u00eb vler\u00ebsimit, m\u00ebnyra se si qeverit\u00eb merren me rastet e propozimeve t\u00eb vetme (nj\u00eb ofertues i vet\u00ebm), dhe kufizimi i negociatave gjat\u00eb faz\u00ebs s\u00eb n\u00ebnshkrimit t\u00eb kontrat\u00ebs.<\/p>\n<p><em><u>Vler\u00ebsimi i raportit p\u00ebr faz\u00ebn e prokurimit t\u00eb PPP-ve: <\/u><\/em><\/p>\n<p><a href=\"http:\/\/www.atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-prokurimit.png\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-1215\" src=\"http:\/\/www.atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-prokurimit.png\" alt=\"\" width=\"626\" height=\"275\" srcset=\"https:\/\/atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-prokurimit.png 787w, https:\/\/atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-prokurimit-300x132.png 300w, https:\/\/atrako.gov.al\/wp-content\/uploads\/2019\/09\/faza-prokurimit-768x338.png 768w\" sizes=\"auto, (max-width: 626px) 100vw, 626px\" \/><\/a><\/p>\n<p><strong><em><u>Menaxhimi i kontratave PPP<\/u><\/em><\/strong><\/p>\n<p>P\u00ebrgatitja dhe prokurimi i duhur jan\u00eb vet\u00ebm hapat e par\u00eb n\u00eb rrug\u00ebn drejt suksesit t\u00eb nj\u00eb projekti PPP. Pasi kontrata e PPP-s\u00eb \u00ebsht\u00eb n\u00ebnshkruar dhe mbyllur financiarisht, fillon zbatimi i projektit. Suksesi i zbatimit t\u00eb projektit do t\u00eb p\u00ebrcaktoj\u00eb n\u00ebse projekti do t\u00eb jap vler\u00ebn\u00a0 e pritshme p\u00ebr para. N\u00eb vend q\u00eb qeveria t\u00eb identifikoj\u00eb dhe t\u00eb vler\u00ebsoj\u00eb nevoj\u00ebn dhe p\u00ebrshtatshm\u00ebrin\u00eb e nj\u00eb projekti n\u00eb form\u00ebn e nj\u00eb partneritet publik-privat (PPP), mund t\u00eb ndodh q\u00eb nj\u00eb subjekt i sektorit privat t\u2019i afrohet qeveris\u00eb me nj\u00eb propozim p\u00ebr t\u00eb zhvilluar nj\u00eb projekt specifik me interes publik. Kompanit\u00eb e sektorit privat, financojn\u00eb studimet e fizibilitetit p\u00ebr t\u00eb p\u00ebrcaktuar specifikimet themelore t\u00eb projektit dhe pastaj ia propozojn\u00eb entitetit p\u00ebrkat\u00ebs qeveritar p\u00ebr miratim.<\/p>\n<p>Duke pasur parasysh natyr\u00ebn e propozimeve te pak\u00ebrkuara, p\u00ebrdorimi i tyre n\u00eb rritje si nj\u00eb metod\u00eb alternative e prokurimit vjen me shqet\u00ebsime t\u00eb konsiderueshme. N\u00eb teori, p\u00ebrdorimi i tyre lejon qeverit\u00eb t\u00eb p\u00ebrfitojn\u00eb nga njohurit\u00eb dhe inovacioni i\u00a0 sektorit privat, por zbatimi i tyre praktik mund t\u00eb paraqes disa sfida, si psh disalokimi i burimeve publike nga planet dhe prioritetet strategjike t\u00eb qeverive, duke \u00e7uar\u00a0 k\u00ebshtu n\u00eb mund\u00ebsi p\u00ebr korrupsion.<\/p>\n<p>N\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb minimizohen rreziqet e mundshme, qeverit\u00eb duhet t\u00eb ndjekin disa praktika t\u00eb mir\u00ebp\u00ebrcaktuar. S\u00eb pari, qeverit\u00eb duhet t\u00eb p\u00ebrcaktojn\u00eb n\u00ebse ata do t\u00eb pranojn\u00eb propozime t\u00eb pak\u00ebrkuara si pjes\u00eb e programeve t\u00eb tyre PPP.
